The Inquiry issued a series of Rule 9 requests to the Ministry of Defence and Royal Military Police to provide comprehensive background information to provide context to the matters being investigated as part of the Terms of Reference. The Inquiry heard this evidence during a two weeks of OPEN hearings in October 2023 where the Chair of the Inquiry heard Statements from:
- Admiral Sir Antony Radakin KCB ADC, Chief of the Defence Staff. This proceeding covered ‘The Green Army and Afghanistan’
- Brigadier Keith Eble, Head Operational Law. This proceeding covered ‘Standards of the British Army, Command Responsibility and the Law of Armed Conflict.’
- Gareth Martin, Director National Security, covering ‘Legal basis for UK Operations
- Colonel Kristian Rotchell, Assistant Head (Technical) Headquarters Provost Marshall, covering ‘Structure and organisation of the RMP’
- Brigadier Matthew Cansdale – Commander Collective Training Group covering ‘Operational staff work, Command and Control and Consequence Management’
The Inquiry held CLOSED hearings in November 2023 where the Chair heard Corporate Witness Statements from:
- Air Commodore Matt Bressani OBE
- A Senior Member of the Armed Forces with expertise in Special Forces, known as ‘the SF Witness’ in the Gist. A gist is a summary of either documents or a hearing transcript that has been redacted or ciphered for publication.
